ESMA Act Invocation for LPG Supply in India

On March 10, 2023, the Indian government took significant measures in response to ongoing geopolitical disruptions affecting fuel supplies, particularly in the context of the West Asia Conflict. The Union Government invoked the Essential Commodities Act (ESMA) to ensure the uninterrupted supply of liquefied petroleum gas (LPG) for domestic use.

Government Directives

In this context, the Ministry of Petroleum and Natural Gas issued orders directing refineries and petrochemical units to maximize LPG production. This increase in production is specifically aimed at meeting the domestic demand for cooking gas, which is crucial for energy security in households across the country.

Additionally, the government prioritized natural gas supply to certain sectors, mandating that fertilizer plants maintain seventy percent of their past six-month average gas consumption. This requirement is intended to ensure that essential agricultural processes continue without disruption.

Furthermore, gas marketing entities have been instructed to maintain eighty percent gas supply to tea industries and other industrial consumers. Similarly, City Gas Distribution entities must ensure that eighty percent of gas supply is allocated to industrial and commercial consumers.

Refinery Adjustments

Oil refining companies have been ordered to reduce their gas allocation to approximately sixty-five percent of their past six-month gas consumption. This adjustment is part of a broader strategy to manage resources effectively during this period of uncertainty.

Measures Against Hoarding

To prevent hoarding and black marketing, the government introduced a 25-day inter-booking period for LPG. This measure aims to regulate the availability and equitable distribution of petroleum products and natural gas, ensuring that households receive their necessary supplies without undue delay.

Current Status

As of now, every producer, importer, transporter, marketer, or distributor of natural gas is required to furnish information to the Central Government. This transparency is essential for monitoring the supply chain and ensuring compliance with the new directives.

Importance of the ESMA Act Invocation

The invocation of the ESMA Act is a critical step for the Indian government as it seeks to navigate the challenges posed by external factors affecting fuel supplies. The Ministry of Petroleum and Natural Gas emphasized the necessity of these measures, stating, “In light of current geopolitical disruptions to fuel supply and constraints on supply of LPG, the Ministry has issued orders to oil refineries for higher LPG production and using such extra production for domestic LPG use.”

This sequence of events underscores the government’s commitment to maintaining energy security for its citizens amidst a backdrop of global instability in fuel markets.
